Tub reglazer guy caused leak in my ceiling.
I hired a tub guy to reglaze my tub. While doing so, he asked if I wanted him to replace the drain and overflow flange. Couple days later after someone bathes in it, I found a big brown spot on my ceiling. After cutting out some sheetrock and filling up the tub, it was obvious that it was leaking from the overflow flange he installed. You can shake the flange and see he forgot to tighten it down.
I called the guy and he denies he did it. I said, 'How could you deny it without seeing it?' He is coming over in a week to see the dammage. Also I told him I just put my house up for sale, and this now will affect the buyer's mindset.
My questions are: What are the steps that I need to take before filing in small claims court? I took pictures and have an invoice. Could there be any punitive damages due to affecting the sale of my home?

You can get forms at the courthouse, and they are usually self-explanatory. As for punitive damages, he is responsible for completing the work in a workmanlike manner - not for your decision to put your house up for sale at this time.
