debt collection

i had membership with a certain video rental store. They accused me of renting movies that I knew nothing about. The debt went to collections. I have contacted BBB who tried to contact this business, but heard no response from them.I have also notified Fed.Trade Comm. The debt that's not mine started off being around $21 but now is over $60. I have learned that the movie store has since gone out of business and I still continue to receive calls from the CA. I have good credit and I'm known by credit report to be responsible for bills that are mine. I don't feel I should have to pay for a system that can not determine who is authorized to use my account and who is not. I feel like someone was able to use my account to rent movies that I should not be responsible for. The store a low security system in my opinion. I'm I responsible for this bill?

You are probably not liable for the bill. If you don't want them to call you tell them not to call you (tape record the conversation and get names). If they call you again, the collection agency has violated the law and you can sue them. Also, if the debt shows up on your credit report you can challenge it. However, you must follow the regulations regarding challenging the matter by writing to the credit bureaus and following procedures. If there are still outstanding issues after the challenge, you may have a claim against the credit bureau(s) and the collection agency.

In short, there are statutes and regulations that may be able to protect you. You should take advantage of low or free consultations of attorneys in your area who specialize in consumer law.
