Legal Question in Credit and Debt Law in Georgia

credit card debts of deceased person

I am the executor of my father's estate. He has about 10 credit cards with balances ranging from $200 to $1500 each. These companies are already calling me to try to negotiate a payoff amount and one has even told me that I have to send payment out of my own money.

My questions are 1)if my father's estate isn't worth enough to cover all of his debt (no house, cars, etc. to sell), can these companies come after me and my finances to get their money? 2) Can they accrue interest on balances past the day of his death and am I responsible for it?

No they cannot make you pay out of your own money, and, unless they ALL reach settlements, then you should pay them each pro rata the same percentage if there is not enough to go around. Have your lawyer write them and stop talking to them yourself. Your lawyer will also help you calculate the fee you can bill teh estate for your services.
