Legal Question in Credit and Debt Law in Georgia

Friend wanting to sue over motel room payment.

Eight years ago a friend and I shared a motel room. The friend paid for $75 of my amount that I was short on paying. Now the friend is calling & threatening to take to court and sue.

Re: Friend wanting to sue over motel room payment.

Why not repay the money and resolve the issue? That seems the easy and correct solution, rather than either of you making it a legal matter.

Re: Friend wanting to sue over motel room payment.

From a purely nonlegal standpoint, you may want to pay the $75 to maintain the friendship.

From a legal standpoint, if you don't care to maintain the friendship, you can assert the affirmative defense of statute of limitations because he waited to long to assert his claim in court. Unless there is some fact regarding partial payment or written agreement or acknowledgement you did not disclose, you will probably be successful in litigation.
