Legal Question in Credit and Debt Law in Georgia

garnishment of bank account

My checking account was put on stop/hold because of a garnishment from an 7 year old bill that was filed in court and given an answer. but I did not receive any court or legal papers to appear in court. Can a company get judgment without an hearing for me? My wife name is on the account also and my grandchild who get social security money is in this account, How can I fight this?.

Yes, a judgment can be entered against you if you do not properly defend. We know nothing about the case, so if you want more specific information, you need to retain a lawyer. The least you can do is get a copy of the file from the courthouse to see what happened, so you don't have to guess what happened.

It sounds like you failed to defend the suit. In some courts you would have to check the calendars to know when a hearing was scheduled. Assuming the judgment exists, your possible choices to stop the garnishment would likely be to pay the debt in full or file bankruptcy.
