Legal Question in Credit and Debt Law in Georgia

lawsuit filed for credit card debt

I have received the lawsuit but have not answered. I have made an agreement with the attorneys to make 3 payments to pay the debt off in 3 months. They sent me a consent judgement form and I want to know how to proceed. I don't want to affect my credit with a judgement.

Re: lawsuit filed for credit card debt

You've done everything wrong so far.

If you are past 30 or 45 days on receipt of the suit without an answer, you've gone into default and no longer can answer. (If it is less than that, see a lawyer IMMEDIATELY to see if a timely answer may help you). Cazses go into default after 30 days, and there is a 15 day period to reopen a default.

Second, a consent judgment IS a a judgment, so it will be reflected on your credit.

What you needed to do was to have the case stay open for 3 months (an answer would have bought that time) and enter into an agreement where they agree not to enter a negative report in exchange for payment, and then have them dismiss the case when paid.

In not answering, you may have lost your leverage to do that.

Without reading the pleadings and the proposed order there is no way for anyone here to tell you if there may be other problems in this case.
