Legal Question in Credit and Debt Law in Georgia

Oral Hearing for Debt Collection

After receiving Civil Suit papers from ''Collection Attorney'', I complied with the 30 day deadline and filed my answer with the Court. That was 90 days ago. I called the Clerk of Court and was told this was not surprising, they could wait indefinitely to file for a hearing. She said I could file for an oral hearing with the judge. My questions is should I. I rejected the claim that I am responsible for the debt. I want this ordeal to be over - what should I do?

Re: Oral Hearing for Debt Collection

Hearing for what? What motion is before the court? We know nothing about your case, and cannot provide specific advice on how to handle your pending case. Your "rejection" likely may not mean much if they have the paperwork to back up their claim. If you want it over, and the debt is valid, consider working out a payment plan. Otherwise, the legal system often goes slow. If you want to defend, get a lawyer to represent you.

If someone is trying to collect from you the absolute worst thing you could possibly do would be to seek to speed up a hearing. Let the case sit. And read Scott's answer to you (I agree with it).
