Statute of Limitations on Debts

Three years ago I had tests relating to surgery. Medicare paid their portion & the hospital did not bill my secondary insurance, nor did they bill me. They recently turned it over to a collection agency. I contacted my secondary insurance co. & was told they would have paid it in full had it been submitted within 2 years of the date of service. Am I liable at this point, since the hospital made no attempt to collect from insurance, not did they inform me that a balance was due. Thank you for your consideration. --

The Statute of Limitations is 5 years. If you gave them the information for the secondary carrier they should have billed them. You were also obligated to notify your secondary carrier. Yes you are are liable.
