Legal Question in Credit and Debt Law in Georgia

unsecured loan 60 days past due summons served for judgement.

I have a unsecured loan with Citi Corp the terms are to pay 310.00 a month. I recently became unemployed and missed 2 payments. I wrote them a statement explaining my situation and reassured them in a few months I would resume payments. I have been a customer with them for 3 years and have never missed a payment. After only 30 days late they servered me a summons for a judgement against me. I have never had a situation like this and need advise on how to preceed. My 30 day answer is due in 2 weeks. Thanks in advance for your help!

Re: unsecured loan 60 days past due summons served for judgement.

Once you were one minute late, they can sue.

Inability to pay is not a legal defense. Unless you answer within 30 days they win automatically, but, even with an answer, you should expect to lose, and once they have a judgment they can later seize paychecks and bank accounts.

It may make sense to file bankruptcy to eliminate the debt and the suit. To discuss this option (if you're in metro Atlanta), get a bankruptcy worksheet and contact us. They are on our website at www.glenashman.com . Act very quickly so your 30 days does not run.
