Access to marital assets
My son-in-law has a U.S. Army bank account in his name only. He has moved out of the home which was shared with his wife and two young boys.
Since he refuses to give her any money, she used his online logon and had funds transfered from his account into their joint account, then withdrew the funds from the joint account.
He claims this is fraud and is filing a police report for grand larceny. There is currently no court order, divorce filing, etc. Does he have a case?

Not if she had his prior authorization to transact business through that account. Even if he never gave his authorization to the wife, it will be a difficult case to prove.
