Legal Question in Criminal Law in Georgia
Statute of Limitations on appeals
A friend accepted a plea bargain....and didn't fully understand the sentencing. Years later, he has found his sentence is not as what was explained to him by his PD at the time of accepting his plea. He was 18 yrs. old, uneducated (only having a 7th grade education), with no help, support, or guidence, other than his public defender. He feels also that he was misrepresented & wasn't given an adequate defense or information. How long does one have to file for an appeal? And on what basis would he have for an appeal under those circumstances?

Simply by your statement "years later" I can tell you that the time is passed.
