Legal Question in Elder Law in Georgia

Is there anything I can do and as power of attorney to protect my mother against my greedy brother and sister. They have already closed my mom's account and took the money. Now it is time to transport her to a rehab and they wont give the rehab the money for mom's care. My brother did have his name on the account but it was my mothers money and now she needs it for medical care.

My mom did give me the POA and signed over the truck title and the quick claim on the property. My brother and sister only know about the POA. I dont know what to do. Please help

Mary

If it's a broad POA, you can bring a claim in your mother's name against your brother. You will have to show that she put all the money in the account through deposit slips or other direct deposit transmissions.

Before hiring an attorney and spending money on the lawsuit, you should send a letter to him certified mail/return receipt or priority mail with delivery confirmation telling him of the POA and informing him of the lawsuit if the money is not returned within X days.
