If there is an active dfcs investigation can the mother which has full custody take the children across state lines and sign rights over to a family member

Obviously that would be an foolish move by the mother. First of all, there is NO such thing as signing over rights to someone. That can only happen with a court order. Obviously,no judge would approve that. second, Georgia courts would retain jurisdiction so the mother wouldbe ordered to court in Georgia. Third, at that point she increases theodds the state wouldtakeher children andprobably screws up a good chance of being reunited. Fourth, it may violate a court order, or if none was violated, cause one to be entered.

If you are the mother, get a lawyer and abandon the incredibly ridiculous plan.

If you're the father, get a lawyer and consider fighting mom for custody; she's about to up your chances.
