Legal Question in Family Law in Georgia

My boyfriend and I are living together and expecting a child in February 2010. I recently found out that he has no intention of continuing the relationship after the baby is born and has been getting legal advise on getting custody of this child after she is born. I am not working (student) and have no income to move out. I have family in another state that I could live with but I don't want to get into any legal trouble for fleeing the state without my boyfriends consent. Would I be in any legal trouble if I left the state before or after the baby is born, even though we are not married?

Unless there is a custody order regarding notifying the court or the father, you can leave the state at any time. After the child is born, he can legitimate the child and seek custody or visitation. Nevertheless, if you wanted to leave tomorrow, you can do so. In fact, if you were living with your parents before he sought custody, you may have a stronger case to maintain custody. With your parents, you should have a stable environment for the baby. Also, don't forget, whether you leave the state or not, you can certainly seek child support.
