Who has best chance for custody

Our son's wife has asked him for a divorce. She is currently on disability for mental problems andhas been diagnosed a bi-polar and borderline personality disorder. She has a history of being in and out of phychiatric treatment. She has tried suicide twice within the last year andhas also tried it before. She has abused illegal drugs (crack and coccaine ) in the home while the child was present. Our son is recovering from cancer. He had cancer in his throat and underwent weeks of radiation and chemo. He had surgery to 'clean up'' the throat area two weeks ago. He is back at work now, however. What chance would he have at gaining primary custody of their three year old. We, as his parents, are willing to help however we can. They all live in Georgia and we live in Alabama.

Your son's physical condition may be an issue against him, but all of the other facts you have described give him a very good chance for custody of their child. He should see an attorney as soon as possible to protect his interests.

At minimum, your son needs to arrange a consultation with an attorney in order to protect his interests in custody and structure his conduct and relationship with his wife in a manner that will enhance his efforts. He may call me if he wants to discuss this further.
