Re: child support and adoption

If you consent to your husband's adopting the child in a step-parent adoption, and if the father either consents or has his rights terminated (which can happen only if he has abandoned the child, failed to pay support for over 12 months or failed to commuincate with the child for over 12 months) his obligations to pay support would terminate as of the adoption date. However, if the adoption is granted, the child becomes your husband's child as much as yours and in the event of a later divorce between you and your husband, he could seek custody of your child.
