child support

if your divorce decree states your child support stops ,when the last child reaches 19.can the x-wife get futher child support if the 19 year old is not able to work in society because of adhd and bipolar ,am i still responsible,will she have to take me to court.

Under current Georgia law, the obligation for child support ends at age 18 but can be extended by agreement or by court order to high school graduation if the child is still in high school at age 18, but it cannot be extended beyond age 20 absent agreement. Right now, the fact that an adult child may have mental or developmental disabilities does not affect this limitation of responsibility.

There may be a bill pending in the Georgia legislature which could change this. It is unknown whether the bill would apply to new cases or could be retroactively applied. My guess is that it would only apply to new cases.
