Legal Question in Family Law in Georgia
Child Support Modification
Dear Sir,
I have been divorced for 2 1/2 years. At the time of my divorce I didn't have money for an attorney so we done our own divorce papers and had them filed with the court after the judge signed them. I was so desperate to divorce this man I agreed to an absurdly low amount of child support. (We have 2 children together). He makes around $30,000 to $35,000 a year as a truck driver and he only pays $30.00 per child a week in child support. How long do I have to wait to get a modification of child support and what steps do I need to take to do this? Also about how long does a modification usually take?

Re: Child Support Modification
You can file a modification now. After filing this modification, you can't do so again for another two years. The length of time this process will take depends. Feel free to contact my office for further assistance on this matter and help with the needed documents. Also, in order to bring this action in Georgia, the father must reside here.
Re: Child Support Modification
You able to seek a modification every two years or when there has been a material change in circumstances; so it sounds as though you would qualify. Also you can ask that the ex pay all attorney fees. The complete procedure may take 2 to 6 months to complete. Please call me tomorrow to get started.
