Legal Question in Family Law in Georgia
child support
I have been receiving $680.00 per month from my ex-husband for our 1 child together. He recently stopped paying child support because he was accepted in to nursing school. He has no plans to work. He will be supported by his live-in girlfriend and student loans. He told me to get a 2nd job because he will pay me nothing while he is in school. If I take him to court for non-payment of child support, what are the likely odds of how I may come out? Will he still be forced to give me something? Will it most likely be a reduced amount compared to what I was receiving before? Also now I will have to carry medical insurance on her which will cost me about $200 extra per month. Will the judge take this into consideration? Please Help!

Re: child support
You are entitled to the support which was ordered until a modification is granted by the court (which will require him to file a petition seeking a reduction). Courts take a dim view of people who become voluntarily unemployed or underemployed. You should hire an attorney right away to file a motion for contempt and show him you intend for the order to be followed.
Re: child support
You need to employ an attorney to assess your support agreement and current circumstances. After that is complete, your options for pursuing continued support will be clearer. Call me if you are ready to take this step.
Re: child support
As stated, you need a lawyer. Call a lawyer who practices family/domestic law as a PRIMARY area and not someone who "dabbles" in eveything. Check profiles and websites, or better yet, ask family, friends or other lawyers for referrals.
