Can I collect alimony?
My husband has left me for another woman and we are separated right now. We have two children and are discussing divorce. He claims they have not had sexual relations. I have copies of several e-mails that he has sent to her about them going on vacation together. I have also caught him at her house. In this case, can I receive support for my kids and alimony?

While adultry can bar the right to alimony it does not automatically entitle the other to receive it. Alimony will depend mostly on finances. You will be entitled to support assuming you have custody of the children, and it would be a good idea to set this up ASAP. Please call me if you have any further questions.

Alimony, while not automatic, can be obtained more easily with the facts you've set out than more innocuous facts. While alimony is generally in popular disfavor, in a just case it can be obtained.
