Legal Question in Family Law in Georgia
custody battle
I have a niece that is 11 years old. Her mother and fatherwere never married, he left when she was 6mo old. So, legally, he isn't a legitimate father. He wouldnt pay his child support for 6-7 yrs & my sister had him locked up. He finally started to pay $40 per week, so my sister will let my niece visit him some on weekends. She went to stay with thim and i got a call from dfacs stating that it had been alleged that the trailer park owner, where her mother lives, had been touching her.Her father called the authorities on a Thursday night and wouldnt allow her to contact her mother or me when this was happening and forbid her to. Dfacs came up with a safety plan for her to stay with me until all is investigated. Her father is also trying to get custody of her. Was it legal for all of that to have gone on Thursday night and her mother wasnt called until Friday evening by Dfacs? Her father told the police that her mother knew that this was happening & did nothing. That isnt true! He has a record of drugs and has been in re-hab!! We dont want him to have the child. How can he now legitimize himself and take custody when he's never been there and he deserted her?

Re: custody battle
The best answer I can give you is for you consult with a local attorney about all of these issues. This is a complicated matter that can have disastrous results if it is not handled properly.
