Custody

I have been married for 12 years and my husband and i can not stay with my husband any longer. I love him but he is so miserable that i can not make him happy. My question is we have a mobilehome and land which are both in my name only but he says since he makes the payment on the home that he will not have to leave and if i try to make him he will make sure i do not get custody of my son. He thinks he can do this because i have something on my record which i was charged a fine and community service both of which has been paid and completed,, does he have a leg to stand on ,, what should i do?

Who gets custody of the child will depend, for the most part, on who has been the primary caregiver up to this point. Your criminal record may have some bearing if this is some sort of offense that affects your moral turpitude or you ability to parent a child. It also depend upon just how old the charge is. You should talk to a lawyer about your case and all of the secifics.
