If there is no custody order, do both parents still have custody of their children? There was a court hearing yesterday. The father had a lawyer, and the mother did not. The father only notified her two days in advance. The father's lawyer lied and lied and lied. The lawyer told the mother to move out of the house by yesterday evening, temporarily. However, there is no custody order. Does the mother still have custody of her children?

No one here was at the hearing to know, and the mother had better do what she should have already done quickly, get a lawyer.
It is irrelevant what the lawyer told the mother. What is her interest in the house? Is there a court order regarding tenancy? Also, if you choose not to obtain the lawyer, you have to be prepared when you go to court. If you had two days notice, you should have asked for a continuance. If there is no custody order, normally, both parents continue to have joint custody.
