Divorce law for Green Card holders

Married in India in 2001. Both husband and wife working in USA on a green card. Asking for divorce on grounds of incompatability. Living seperately since more than one year

If you have resided in the State of Georgia for at least 6 months, you and your spouse can file under the ground the marriage is irretrievably broken which is the no-fault ground. The divorce should be filed in the county where the defendant resides. However, if the defendant agrees, it can be filed in the county where the plaintiff resides. In this event, the defendant would acknowledge service and execute a waiver of venue. The quickest way to obtain the divorce is to also enter into a written settlement agreement. I hope this helps.

If you have both been residents of Georgia for more than six months, you can file on the no-fault ground that the marriage is irretrievably broken.The case should be filed in the county where the other spouse resides.
