divorce

i live in georgia and want to get a divorce. my ex lives in south carolina. can i file for divorce in georgia?

Yes, you can get a divorce in GA. However, the divorce is the only issue that can be decided in GA. If there are any other issues, e.g., child custody, support, division of property, etc., they will have to be addressed in SC. However, if your spouse is willing to consent to jurisdiction in GA in an uncontested divorce, that can be done also.

You can get a divorce in Georgia if you have lived here for over 6 months. I am talking here only about the dissolution of the marriage. Other issues wil be addressed below.

If you want any other relief (child custody, child support, alimony, division of property, etc.) and if your spouse has no connections with Georgia (never lived here, children are in South Carolina, etc.) you may not be able to get that relief here and may have to do all of that in South Carolina.

I would suggest you speak with a family law attorney, possibly in both states, to be sure of the best place to file.

Assuming you have lived in Georgia at least six months, you can file in Georgia. If the case is uncontested, this can be done fairly easily. If contested, the issue as to where you should file is more complex but you may still be able to proceed here. Please call me if my office can assist you with the case.
