Divorce in a different state

I was married in the state of New York 8 years ago.6 months ago I moved out of the apartment where I lived with my husband and moved to Atlanta,GA;I am a resident. Is it possible to get a divorce here?? We have no property,no children and it would be an uncontested divorce.How long would it take,on average??

Once you have lived here six months it is possible to file here. Georgia's divorce laws are faster and simpler than New York's, and if your wife will sign, a case can be handled here in about a month at mimimal expense. Please contact my office if we can be of assistance to you.

It appears from your question that you can get a divorce in Georgia because you meet the residency requirements and the Court here has jurisdiction over the marriage because of your presence here and can dissolve that marriage in a divorce case. Assuming your husband has had no contacts with Georgia the most you could do in such a case is get the divorce. Since you indicated there are no children and no property (and I assume no issues of your needing alimony or spousal support), then a divorce is all you may need.

The case would be filed in the county where you live and served on him (I assume he is still in New York). If you do not know where he is, it is possible to have him served by publication of a notice in the local newspaper for 4 weeks.

If he agreed to the divorce and signed a consent to the case being heard at the earliest possible date, that would be 31 days from the date he was served or signed a receipt acknowledging service and that receipt was filed. If he is served or acknowledges service and does not sign that other form, the earliest would be 46 days. If you have him served by publication, the earliest is 61 days after the first notice is published in the paper.

If your circumstances and objectives are as simple as you suggest,then you should be able to obtain a divorce relatively quickly without incurring sizeable fees to do so. However, you should employ a lawyer to make sure that your you will attain a divorce that can never be invalidated. Please call me if you would like to discuss this.
