Legal Question in Family Law in Georgia

I am a divorced mother of two children. Recently, my oldest moved in with her father. How does child support work since now I have one child and so does he? Is it a wash or does the court base it on salary?

The Court has a very specific equation that it uses to determine who pays what for child support. I strongly recommend that you hire a Georgia family law attorney to consult and protect your rights.

Right now he still must pay both of you the old number until and unless one of you goes to court and obtains modification.

The answer as to amounts depends on your respective incomes and other factors, so it may not be a wash. In any event, in this situation it is vital that you get a lawyer ASAP. If you're in metro Atlanta, feel free to call me with more details

There is a formula the courts use to establish child support. I suggest you go to https://services.georgia.gov/dhr/cspp/do/public/SupportCalc to get some idea on the change in child support. Also, in the meantime, everyone should comply with the current court order.

If you don't already have an attorney, I am available to discuss this with you further.
