Legal Question in Family Law in Georgia

I am the father and i pay child support to the grandparents (who have custody), i have no rights to my daughter, but the grandparents do allow her to stay over now and then, recently they have been kind of pushing her off on us and my daughter asked us tonight if we could get joint custody of her that way she can still see them but they will have to let us get her too. i know i will have to get her legitimized, but do the grandparents have to sign the papers or does the birth mother sign?

You file the petition. The mother doesn't necessarily have to sign the petition. However, she can consent to the legitimation. Of course, the consent will make the entire process faster and easier.

Also, you can file a petition for legitimation, joint custody, and child support modification in one action. Again, if the legitimation part is consented to by the mother and the joint custody and support modification sections are consented to by the mother and grandparents, the entire process should be resolved quickly.
