Fathers Rights

Two years ago my son had an affair with a married woman. Twin sons were the result. The woman kept distant from him leading my son to believe they were not his. The truth is out now that they are! What I would like to know is, what can my son do to get his rights. He is willing to pay child support, but he also want to see his sons. Also, he wants his sons to have his last name. Is this possible? Thank you

It appears from your post that your son would have the right to file a legitimation action to establish his paternity of the children and to make them his children legally. This action would also establish his obligations for child support. Unless the mother agreed to combine the actions into one, under Georgia law, he may have to file a separate action afterwards to establish the custodial rights, including visitation. I recommend that he hire an attorney for these actions.

He certainly has the right to file an action seeking visitation rights. I would expect a counterclaim for child support. If paternity is challenged, that could be made an issue too. Please call if you have any further questions.
