Legal Question in Family Law in Georgia

Fathers Signing Their Rights Over

The father of my baby thinks if he signs his rights over he will not have to pay for child support but this other lady told me that even if he does... he will still have to pay child support. So my question is... If he does sign over his rights of my daughter, will he still have to pay for child support?

Re: Fathers Signing Their Rights Over

Parents can not sign away children. (The only excception is during an adoption, where one parent has agreed to replace the bio-parent).

A child has a right to be supported by both parents and it is a crime in Georgia for either parent to fail to do so, regardless of whether there is a court order.

If the father fails to pay support for 30 days, either swear out a criminal warrant for abandonment (go to Magistrates Court) or if he is gainfully employed, go to the State Child Support Enforcement office nearest you.
