Legal Question in Family Law in Georgia

Fraud or Not

My ex-wife recently disclosed to our 19 year old daughter that I wasn't her biological father even though my name is on the birth certificate. I have paid child support since February 1992 with the last payment ending in April 2003. My daughter was so upset that she now doesn't want to have a relationship with me. I have tried to contact her but to no avail. Is there any recourse for me, legally?

Re: Fraud or Not

This may be a case of paternity fraud. There is not clear law in Georgia on this yet, but I am presently handling a case involving similar issues. A recently enacted statute deals with the termination of future support obligations in the event of such fraud but does not provide a statutory remedy for the support paid prior to that. Recent appellate decisions still leave open the question of whether common law fraud damages are available. I believe they are, under a variety of legal theories, but the decision has not yet been made by the court in our case.

You should certainly contact an attorney with experience in these areas to see what remedies may be available and to advise you on how to proceed.
