Legal Question in Family Law in Georgia

My Husband wants to adopt my son.

I was recently married. My husband would like to adopt my 7 year old son. I do not know where his father is. I have an old email address from 2 years ago. He does not pay any child support. What steps do I need to take to make the adoption happen?

You may well be able to do a step-parent adoption, which would involve a termination of the father's rights. You should consult with a local attorney familiar with these issues. If you would like to discuss further, feel free to give me a call.

Re: My Husband wants to adopt my son.

You are looking at what is called a step-parent adoption. It would be far simpler if you had the father's consent, but, depending on detailed facts I'd need to discuss with you, it may be possible to terminate his rights and do an adoption.

Probably only 1% of lawyers have done enough adoptions to understand the very intricate process. We have been doing them with some frequency for 26 years.

Re: My Husband wants to adopt my son.

If a mother has remarried and the father has failed to pay support or communicate with the child for more than 12 months, the stepfather may be permitted to adopt the child. The natural father's parental rights would be terminated in the process.

You should contact a lawyer to discuss the situation in more detail and to take action for you if you desire to proceed.
