You didn't say if your husband has ever filed a legitimization. Until and unless he does, he cannot seek custody or visitation. Step one is see a lawyer.

Your husband can file a petition for legitimation and custody at the same time. He doesn't have to file two separate petitions. This should be done in the county where the wife lives.
