Legal Question in Family Law in Georgia
My husband and I lost our children temporarily and they are now in state custody. My husband is incarcerated and I want a divorce. Since our daughters are in DFACS custody can he contest the divorce based on the children?

In Georgia, you can file for irreconcilable differences. In that case, it would be difficult to contest it because he is in jail. Also, depending on his length of incarceration, you might have grounds on the fact that he in prison. Nowadays, children aren't a barrier to divorce.
