My husband has had sole custody of his 13 yr old son since he was 3 yrs old. (I have been step-mom since he was 1). Son's Mom has every other weekend visitation. Son is medically fragile. He has had 2 open heart surgeries, takes blood thinners among 5 other medications. In just the past yr alone when I take him to get his blood work drawn, for blood thinner range, It has been either extremely high or extremely low. high means he is not eating or taking it all right before he comes home. low means he has missed a dose. Today the results were double what the should be and the staff at the heart center said next time the results were not in range they would be getting social services involved and removing child to safe environment. Every time I have told them he just got home from his other parents house. I have sent his mom e-mails on how he has to eat and take meds repeatedly. I have kept all of this documented. Ok now question... Can my husband shorten her visitation to just Saturday? I can't stand the thought of son going to foster care even for one night. What can we do???

Your husband should file a petition to modify visitation. The basis should be the medical harm she may be causing by not taking care of him properly. He should think about hiring an attorney to file the petition. However, if it's financially impossible and he doesn't qualify for a pro bono attorney, he can file the matter on his own.
