Legal Question in Family Law in Georgia

joint custody

My exhusband and I have joint custody of our 4 year old daughter. When we got the divorce, we both lived in Georgia and filed in Muscogee County. In the past year, we both moved to Alabama, and I shared a residence with him for a brief time, although we were not a couple at that time. Then I moved to my own place for several months in Alabama, and now I have moved to Athens, Ga which is approximately 170 miles from where he resides in Alabama. I have moved here to go to school, and it is where we both grew up and all of our families are here. Does he have the right to tell me I cannot move here without his permission even though this is where we are from and he does still occasionally travel up here? What is the limitation about how far I can move without his permission?

The answer largely depends on the terms of your settlement agreement and final decree. At the very least, a modification of the amount of the visitation or custodial time will probably be necessary. You should consult with a family law attorney in your area to discuss the situation. I can recommend several in the Athens area if you wish.
