Re: what is legal age

At 17, she is old enough to elect to live with you and you can file a modification petition in the county where the father resides and where she has been residing, accompanied by an affidavit signed by the child stating her election and preference to live with you. This is not effective until an order is entered so you want to schedule a hearing as soon as possible.

She is not an adult until age 18, but I understand that she cannot be considered a runaway after age 17. My suggestion though is to go through the modification procedure described above, to avoid the possible claims of interference with custody (crime) or contempt for violating the existing order.
