I live in Georgia and need to know how to file for divorce and custody of my children who currently live with me but the mother lives out of state in North Carolina.

If you have lived in Georgia for the required time period of 6 months, you can file for divorce. It is irrelevant that your wife lives in North Carolina. Because there are probably issues relating to child support and custody, you should hire an attorney.

If you decide to file the matter on your own, you should take significant time to learn your rights relating to property division, custody issues, and child support. If you don't believe you can afford an attorney, you should look into pro bono services that may be of assistance. In certain county's they have family law pro bono services. Also, because you are relatively close to UGA's law school, you may be able to obtain assistance from the school's clinic.
