Mediation - Settlement Agreement
We have been to mediation and divided property. The Settlement Agreement has been drawn up but he now has decided to refuse to sign it and go to court. Can he legally do that?

Unless the results of the mediation were put in writing and signed, he can refuse. I assume you had a lawyer at the mediation. Consult with him/her.

If the mediated agreement was written down in a memorandum which you and he signed, and if it was sufficently detailed as to the terms of the agreement, you can probably get the court to enforce the mediated agreement by filing a motion to enforce it. If you do not have one, you should see a family law attorney promptly to review the facts further.

Yes. However if there is a signed mediation form with the agreement, your lawyer may be able to compel compliance.
