Legal Question in Family Law in Georgia

Modifying a Protection Order

I have a protection order placed against me and a no contact order due to a family violence incident my wife and I got into. During the hear for the protection order, my lawyer told me not to say anything and him the judge and my wifes legal aid agreed to extend the protection order to 12 months without me testifying. They are assuming my wife will file for divorce. I have a 6 year old daughter and want to see her. We are going broke because the amount of money the judge awarded is way past our budget with me living outside of the home. Can these orders be modified due to financial constraints and visitation if noone is filing for divorce?

Re: Modifying a Protection Order

It is impossible to answer you as no one here has read the order or pleadings. Your lawyer should have already discussed the possibilities with you, including the possibility of yoiu filing a divorce, which might change or affect the order.

Re: Modifying a Protection Order

You said you have a lawyer - discuss with him/her. No one here knows near enough about the case, and certainly cannot tell you to file for divorce ASAP when you don't even state you want to do so. Speak with your lawyer.
