Legal Question in Family Law in Georgia

My niece is on drugs and has two kids she is 18 years old her mom and dad raise the two girls. The babies dad is also on drugs and has tried many times to get clean but fails. If something should happen to the babies mom can the dad get custody of the two little girls.

If he chooses to seek custody, he would get custody if she died. He might have to legitimize the children.
