pet ownership in a divorce

I have been divorced since 11/2/02 since then my dog has been living and cared for by me. Now my exwife threatens to take the dog. Who has legal right when it is not mentioned in the decree? We are agreed to 50% of everything and she already took the three horses, the cats and one other dog.

The answer will depend on the language of the agreement and order. If it is truly silent on the dog and says that any other personal property in your possession is yours, then she has no right to the dog.

If you have additional questions on this, you should speak with an attorney to review the agreement and possibly address the issue in a letter to your former wife that she has no right to the dog and that any litigation she may file over the dog will be considered as frivolous and met with a demand for the court to award you attorney's fees.
