Process of Divorce

I've been married to my husband for almost three years. We are not getting along in the household.I have 4 children that are not his. He threatens me sometimes that he can put me out. He said that he would give me a week to find somewhere to stay. I am trying to get myself together so I can have the money to put down on a place to stay. My question is can he put me and my children out of his home because my name is not on the mortage loan company? He had the home before we got married. Am I allowed time, like at least six months to get myself together? And I also just started back working on my job back in September,I was out of work for almost a year because he wanted me to stop working.

If you don't agree on moving, the issue will be up to the courts. That likely will take many months and will cost both of you significant attorneys fees. To make you move he needs a court's help and that isn't likely, absent domestic violence, to be instant.

You should consult with a local attorney about a divorce. Even though the home is in his name, you have certain marital rights in it.
