quailifed domestic retations order
My husband and I have been married since August 23, 2002. He retired from BellSouth, (Georgia) 2003. He pulled all of his pension out of the BellSouth savings plan, $383,000 dollars. He invested a total of $303,000 into an IRA account with Smith Barney. What he did with the remaining $80,000 I don't know. He received additional income from BellSouth totaling $120,000.00, but I don't know he did with that. He is disabled according to the VA and Social Security Administration. He has presented me with divorce papers and I refuse to sign them. I know that most of his pension was accumulated before we got married, I just want to know what my rights as his wife. His beneficiaries are his only son and his son's daughters. (grandaughters) He has not provided any compenstaion for me in the event of his death. He is sick and I am trying to take care of him as best I know how. Do I have any options or legal rights in this situation? He is on disability with VA and Social Security. He recieves approximately $5100.00 per monthly and he does not share or provide any thing with me. I am 58 years old and having an etremely hard time. What can I do? Please hellp me!!

You need to speak with a divorce attorney as soon as possible to discuss the case and review the papers he gave you. The divorce court could provide you with temporary suppport and enable you to discover what happened to the money. Failure to act now may cause much of that money to disappear.

It is impossible to give you a reliable answer as to your rights based on the "snapshot" you have provided. You should retain an attorney as soon as possible. All the facts you have mentioned need to be investigated and documented.

An attorney will need to have more information and will want to examine the divorce documents that your husband gave you in order to determine your options.
