Legal Question in Family Law in Georgia

Can I reduce ex-wife monthly payments

Divorced in 2004, paying alimony of $2000.00 a month for 3yrs till Dec. 2007, she is engaged now and living with him. The house is empty and no one living there. However, she makes house notes($700) along with 2nd note($140). Is it possible to have it reduced now that she doesn't live at her old home?

Re: Can I reduce ex-wife monthly payments

Georgia law allows (but does not require) a court to modify alimony if the recipient spouse is living in what is called a "meretricious" relationship. This is defined as one similar to marriage, where they are living together, sharing expenses, etc. Your agreement may affect whether or not you may file for modification under this ground, so you should see an attorney as soon as possible.

Re: Can I reduce ex-wife monthly payments

The answer is completely dependent on the language of the settlement agreement and/or divorce decree, so there is no way to answer your question absent reading those two documents in their entirety.

You will need to employ an attorney to review your divorce documents in order to assess your options. Call me if you want more information about what that entails.

The above information is offered as a courtesy and does not imply nor create an attorney-client relationship.
