Legal Question in Family Law in Georgia

rescindment of legal separation

My husband and I filed a legal separation agreement with the Gwinnett County Court system in October 2004. We have since reconciled and wish to nullify the separation. Both my attorney and the Gwinnett County Court staff have said no formal action is needed. However both internet research and common sense tell me a formal document should be filed, putting our change of status on record. The separation agreement dealt with custody of our minor children, property division, financial obligations, income tax issues and other important matters. Please tell me 1)the name of the legal form which rescinds the separation and formally restores all aspects of legal marital status, and 2)the customary means of filing such a form under Georgia (Gwinnett County) law. Thank you very much.

Re: rescindment of legal separation

It's very simple. Whoever was the Plaintiff in the action that was filed files a pleading titled "Dismissal" with the language that "The Plaintiff hereby dismisses his/her previously filed Complaint".
