share workers comp settlement

I live in georgia and may be getting a divorce. Will I have to split my workers comp settlement with my spouse. I have not received it yet.

Georgia analyzes such awards and provides that the portion that represents lost income or medical expenses is marital and is subject to equitable division. Any portion that represents pain and suffering is unique to the injured worker and is the separate property of that spouse. Any portion of an award (usually not applicable in comp cases but found in personal injury cases) that is for loss of consortium is the other spouse's separate property.
