Legal Question in Family Law in Georgia

I was a stay at home mother the whole marriage. My husband was very abusive to me and my son.He filed a false TPO against me, had me removed from my home, and took my son. I had the TPO dismissed, and spent over 2 months looking for them, so that I could get my son back. I finally located them, and we signed an agreement for me to have visitation. I took whatever I could get at the time, because I thought he was going to run away with my son again. He has been going against the agreement by having me pick my son up at earlier times, from different locations, etc. I also have been working with CPS about his neglect toward my son. I was told by CPS that since a judge has not signed anything regarding custody of my son, that I am allowed to go get him. They stated that I should be able to keep him after filing a complaint with my local law enforcement, and not have to take him back to my husband. I am still not sure, and I don't want to make the wrong move.

Many, if not most, of the obstacles you have faced could have been avoided if you hired a lawyer. That is still the answer to your questions.

I agree with Attorney Riddle. You should check with your local bar association to determine if a pro bono attorney is available for the custody dispute and the divorce.
