Step-parent adoption
My husband and I have been married for 5 years. My oldest son is not biologically his. My son is now 8 years old and his biological father has not attempted to contact me in any way, for the past 6 1/2 almost 7 years. My husband would like to adopt my oldest son, but we are curious as to the abandonment clause, or exactly what we would have to do to make the adoption as smooth as possible.

A step-parent adoption is possible under Georgia law with the consent of the biological father or without his consent under circumstances such as those you have described, where he has failed to support the child or communicate with the child for over 12 months.

The simplest way to do a step-parent adoption is with the consent of the bio-dad. In cases where bio-dad has failed to support or attempt to visit the child, a court may also allow an adoption, depending on the circumstances.
