Step one is to hire an attorney.
You will need a judge to grant a modification request. I advise you not to undertake this without the services of an attorney.
In general, a father if married to the mother at the time of birth or a father who has legitimated the child has equal rights to the child. The judge looks to the best interest of the child as it relates to visitation and custody. Child support is based on an income formula. If you need to decrease child support because of a decrease in income, you should file a motion to modify the support. With the bad economy, it is no unusual for the noncustodial parent to seek a downward modification.
Your rights as a father can be explained further by scheduling office visits with several attorneys. If you decide to retain an attorney for the matter, select the one who fits your budge, comfort level, and experience requirements.
