In general, a father if married to the mother at the time of birth or a father who has legitimated the child has equal rights to the child. The judge looks to the best interest of the child as it relates to visitation and custody. Child support is based on an income formula. If you need to decrease child support because of a decrease in income, you should file a motion to modify the support. With the bad economy, it is no unusual for the noncustodial parent to seek a downward modification.
